Two Finalists:

TOP SHOT - Image requirements:

1. All entries must be submitted only in JPEG (RGB) format.
2. Data size of entry is limited to 1 Megabyte or lesser. Data exceeding 1 Megabyte in size will not be accepted.
3. Photograph at the maximum resolution and minimum compression rate that your phone camera allows. Be certain to retain original data in actual size as actual prints of winning entries will be required for reproduction and publication in newspapers.
4. There are no restrictions on the mobile phone brand used for the purpose of this contest.

Sony Ericsson Mobile Communications AB, (”Sony Ericsson”) hereby invites you to participate in the Sony Ericsson Top Shot competition (”Competition”). These terms and conditions apply to the Competition

PHOTO CONTEST
Send in entries of images capturing something/a situation that are spontaneous, humorous or interesting.

Submission of entries online is via the site: http://www.sonyericsson.com/topshot

Entries must be accompanied by a photo title and the following information:
- Image shot with which hand phone brand and model number
- Details of contestant (name, gender, country, hand phone number, email address, date of birth)

There is only one generic category for entries and it is open to all age groups.

PHOTO CONTEST RULES

1. Only photos captured with a mobile phone will be accepted.
2. Photos will be accepted only from the original photographer.
3. The photographer must own the copyright to the photo. No public domain pictures will be accepted.
4. By submitting your entry, you agree that Sony Ericsson can publish your picture on the website gallery. You hereby grant Sony Ericsson permission and rights to store, display, and use the image, its thumbnails, and your name as the photographer and that you agree with these Terms and Conditions. Incomplete submissions or any submission that is considered, in Sony Ericsson’s absolute discretion, to be hateful, religious, exploitative, obscene, suggestive of illegal activity or is otherwise objectionable, will be rendered invalid and rejected. Photographs containing nudity will not be considered. Sony Ericsson retains sole discretion as to what constitutes unsuitable content.
5. Photographs that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud. When photographing the artwork of others, it must be as an object in its environment and not a full-frame closeup of another person’s art.
6. Photographers must have sufficient permission of any recognizable models or other persons appearing in the photograph to be able to grant to Sony Ericsson the right to display their photographic submission online.
7. Any contest submissions that receive legal challenges from either copyright or insufficient model permissions will be removed.
8. Entry to the Competition is open to citizens and permanent residents of Philippines, excluding employees of Sony Ericsson, its affiliates and any of their associated companies, members of their families, and anyone else professionally connected with this Competition. In any event, Sony Ericsson reserves the right to refuse any application for entry in its sole discretion.
9. No purchase necessary. Please follow Competition instructions. No applications will be accepted by agents or third parties. Winners will be notified by telephone within 28 days of the promotion end date.

JUDGING CRITERIA

1. The winners will be chosen by a panel of judges. Photos will be judged on the basis of the following criteria:
   • Spontaneous, humourous or interesting - The ability to identify and capture the imagination of the viewer through humour, and the unexpected nature of the resulting image.
   • Originality - The capacity to identify, capture freshness and originality of the subject matter.
   • Artistic creativity - The ability to capture expressions to bring out the humour in the resulting image.
2. The image will be open for public viewing on the website 24 to 48 hours after submission
3. The Judges decisions are final and binding and no correspondence will be entered into. All winners will be expected to provide Sony Ericsson with such proof of identity as Sony Ericsson shall in its sole discretion request.

GENERAL RULES

1. Closing date for receipt of applications is July 22, 2007. No entries will be accepted after that date.
2. Only one entry may be submitted per participant.
3. By entering the Competition you hereby accept and agree that Sony Ericsson’s Legal Notice including User Terms and Privacy Notice www.sonyericsson.com/legal apply.
4. The grand prize winner wins round trip tickets for two to Boracay (Caticlan Airport) , PhP 10,000 in cash, and a K810i phone. The rwo remaining finalists win a K550i phone each. Prizes must be claimed within 60 days from the announcement of winners. Round-trip tickets have a validity period from issuance. Should any prize become unavailable for whatever reason, Sony Ericsson reserves the right to provide a substitute prize, in its sole discretion.
5. Prizes cannot be substituted for cash or other alternatives, in whole or in part.
6. If a prize winner is under the age of 18 they must nominate a parent or guardian to claim the prize. Restrictions may apply to any winner that is under the age of 18.
7. If the winner does not respond to our notification and claim the prize within 60 days, the prize will be forfeited.
8. Proof of sending is not proof of receipt.
9. All entry instructions form part of these rules.
10. The winners may be required to participate in related publicity.
11. Winning photos will be posted on the website and may be published in a local newspaper.
12. Sony Ericsson reserves the right to disqualify any entrant at any stage or to refuse to award any prize in the event that it finds, in its sole discretion, that the entrant has breached any of these Terms, has provided any inaccurate or untrue information or has otherwise acted in violation of the law.
13. On entry to this promotion, the prize winner agrees that the winning image can be used by Sony Ericsson for promotional purposes. As a participant you hereby guarantee that you own all intellectual property or other rights necessary for distribution and public display of any submitted content regardless of the format that it is provided in, and you hereby grant Sony Ericsson, its subsidiaries and branch offices the perpetual right to exclusively, royalty-free and without limitation freely use, modify, edit, copy, reproduce, distribute, translate, create derivate works from, alter and publicly display or publish such content, for whatever purposes, in any form or medium, either on this web-site or elsewhere, whether promotional or in other activities or events arranged by Sony Ericsson or any of the above stated parties, whether locally or world-wide.
14. Information regarding personal data provided in the form will be collected, stored and processed in a database for the purposes of managing the Promotion. Such information will not be used for any other purposes than as stated in these rules or as separately accepted by you. The Sony Ericsson Privacy Notice applies to any processing of data performed in connection herewith displayed at www.sonyericsson.com/legal. You hereby agree that we may use your personal data to confirm by e-mail your successful registration and to inform you in case you have won. 15. All participants are responsible for any costs, taxes, duties or levies incurred by them as a result of participation in the Promotion. In addition, you hereby agree and accept that if you win the Promotion you may incur taxes, duties or other levies including but not limited to any prize tax, operators’ subscriptions fees etc under any applicable laws and regulations. 18. Neither Sony Ericsson, nor its subsidiaries, branch offices or partners accept any liability whatsoever for:
    • lost, damaged, misdirected or late entry submissions; or
    • technical difficulties that may affect electronic communication, the final results of or entry to the Promotion; or
    • any content regardless of the format that it is provided in, that is offensive, discriminatory, confidential, in violation of applicable legislation or infringes any third party or other protected rights under applicable laws or treaties; or
    • any losses suffered by entrants in connection with this Competition and Sony Ericsson accepts no responsibility or damage, loss or injury resulting from the acceptance or use of any prize offered in this Competition; provided, however, that Sony Ericsson does not exclude its liability for death or personal injury caused by its own negligence.
19. Sony Ericsson reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently this Competition or any part thereof, with or without prior notice to you.
